A Ft. Wayne, Indiana jury awarded DeLaney & DeLaney client Emily Herx nearly $2 million by a verdict announced on Friday, December 19th, 2014. The jury unanimously found that the Defendant violated Title VII of the Civil Rights Act of 1964 when it terminated Mrs. Herx's employment as a teacher at St. Vincent de Paul School because of her efforts to become pregnant through in vitro fertilization. Kathleen DeLaney and Christopher Stake successfully tried the case on behalf of Mrs. Herx in the United States District Court for the Nothern District of Indiana, arguing that the Defendant forced the former teacher to choose between having a baby and keeping her job. The jury agreed and awarded Mrs. Herx almost two million for emotional and physical pain and suffering, $125,000 for medical expenses, $65,000 for lost wages, and $1 in punitive damages.
