On March 11, 2013, Judge Robert L. Miller, Jr. heard oral argument on Defendants' Motion for Judgment on the Pleadings and ruled from the bench, denying Defendants' request to dismiss Emily Herx's lawsuit. The case will now proceed with discovery.
