Webster v. CDI (Medical Malpractice) - $15M jury verdict upheld on appeal

DeLaney & DeLaney LLC as co-counsel to Garau Germano P.C. represented Courtney Huston Webster in a federal case arising from a radiology group’s failure to detect a cancerous tumor on a CT scan, resulting in a dramatically diminished life-expectancy for the mother of two teens. The case was brought in federal court outside of Indiana’s medical malpractice statute because CDI had not opted into that system and was not covered by statutory damages caps.  After a five-day jury trial, a $15 million verdict was returned, which was upheld on appeal.  Reported case decisions:  Webster v.
