Jury Awards Emily Herx Nearly $2 Million

A Ft. Wayne, Indiana jury awarded DeLaney & DeLaney client Emily Herx nearly $2 million by a verdict announced on Friday, December 19th, 2014. The jury unanimously found that the Defendant violated Title VII of the Civil Rights Act of 1964 when it terminated Mrs. Herx's employment as a teacher at St. Vincent de Paul School because of her efforts to become pregnant through in vitro fertilization. Kathleen DeLaney and Christopher Stake successfully tried the case on behalf of Mrs. Herx in the United States District Court for the Nothern District of Indiana, arguing that the Defendant forced the former teacher to choose between having a baby and keeping her job. The jury agreed and awarded Mrs. Herx almost two million for emotional and physical pain and suffering, $125,000 for medical expenses, $65,000 for lost wages, and $1 in punitive damages.

Kathleen DeLaney Elected to The American Law Institute

Kathleen DeLaney has been elected to The American Law Institute (ALI).  ALI is the leading independent organization in the United States that produces scholarly work to clarify, modernize, and otherwise improve the law.  The Institute drafts, discusses, revises, and publishes Restatements of the Law, model statutes, and principles of law that are influential in the courts and legislatures, as well as in legal scholarship and education.  Her election to the ALI was featured in an article "New Members of the American Law Institute Bring Engery and Diversity," which was published by the Indiana Lawyer on May 21, 2014.  Kathleen was quoted in the article, stating, "[I]f we can make the Restatements an accessible resource so that people can understand them when they read them and they're not full of acrane legalese, I think those are good aspirational goals to have which could have the added benefit of making the legal process more accessible and understandable."  The article was also featured on The American Law Institute's website at www.ali.org.
