On October 7, 2013, the United States District Court for the Northern District of Indiana ruled on Emily Herx's Motion to Compel Complete Responses to Written Discovery. Instead of limiting the scope of discovery to the school where Emily Herx taught (as urged by the Defendants), the Court has ordered the Defendants to provide responses to requests for information from all forty-one schools within the Diocese. Ms. Herx, a teacher from Ft. Wayne, Indiana, has gender, pregnancy and disability discrimination claims pending against the former employers who terminated her for receiving medical treatment for infertility. Her case has been widely reported by the news media, including features on The Today Show, CNN, and NBC Nightly News with Brian Williams.
Jillian Szalankiewicz passed her PACE exam on June 21, 2013. She will be eligible to receive her RP® credential in August of 2013.

On March 11, 2013, Judge Robert L. Miller, Jr. heard oral argument on Defendants' Motion for Judgment on the Pleadings and ruled from the bench, denying Defendants' request to dismiss Emily Herx's lawsuit. The case will now proceed with discovery.
